Data Protection Bill: Those who steal data are not well, now a fine of up to Rs 500 crore can be imposed

The central government has increased the fine amount to Rs 500 crore for violating the proposed provisions under the draft Digital Personal Data Protection Bill 2022 released on Friday. The draft Personal Data Protection Bill in 2019 proposes to impose a penalty of up to Rs 15 crore or 4 per cent of the global turnover of an entity. The draft proposes to set up a Data Protection Board of India, which will function as per the provisions of the Bill.

Fine will not exceed Rs 500 crore

The draft states, ‘If the Board, on the conclusion of the inquiry, determines that the non-compliance by any person is material, it may, after giving the person a reasonable opportunity of being heard, impose such financial penalty as is specified in Schedule I, which shall not exceed five hundred crore rupees in each case.’

Can comment on the draft till December 17

The draft proposes a penalty of up to Rs 250 crore if a data fiduciary or data processor fails to protect against breaches of personal data in its possession or under its control. The draft is open for public comment until December 17.
